The sale of wine on this website www.mosole.com is governed by these General Terms and Conditions of Sale. Users who utilize the services offered on mosole.com declare that they are aware of and accept these General Terms and Conditions of Sale.

For Tenuta Mosole, a final consumer is defined as any individual acting on the website www.mosole.com.
Tenuta Mosole exclusively caters to end users who are consumers and at least 18 years old, in compliance with the applicable laws and regulations regarding e-commerce. By using the mosole.com site, the user guarantees they are over 18 years old and that the person receiving the shipment will also be over 18 years old.
The General Terms and Conditions of Sale exclusively govern the offering, transmission, acceptance, shipping, purchase procedures, and right of withdrawal for purchase orders of products on the mosole.com site, between users of the site and Tenuta Mosole. They do not govern the provision of services or the sale of products by third parties who may be present on the site via hyperlinks, links, or banners.
The General Terms and Conditions of Sale are periodically updated by Tenuta Mosole according to the development of its business and the market, as well as in compliance with any legislative updates or amendments. PURCHASE PROCEDURE

All orders submitted constitute an offer to purchase the products listed on the site. Orders are subject to the availability and acceptance of Tenuta Mosole, which reserves the right not to confirm an order, particularly in the event of the unavailability of one or more of the purchased products. In such cases, Tenuta Mosole will refund the price and any shipping costs incurred by the User.
The actual availability of a product is approximate, as multiple users may purchase the same item simultaneously, rendering a product unavailable that another user had already added to their cart.
The images displayed are indicative and do not guarantee the quality of the products. Additionally, the photograph may not always represent the vintage actually for sale, as the vintage listed in the product description is the only one considered valid.
An order is placed upon confirmation and is subject to the payment of the price, taxes, shipping, and payment fees as specified in the order summary.
The Order Processing Receipt does not constitute acceptance of the order. The contract is finalized when Tenuta Mosole sends the Order Confirmation to the email address provided by the User. The Owner reserves the right not to confirm an order by notifying the User via the email associated with the purchase about the possible unavailability of one or more of the purchased products. In such cases, the Owner will refund the price and any shipping costs incurred by the User.
The prices listed on the site include VAT, and the transportation costs are shown separately in the order form and on the invoice. Published prices may be subject to change without notice: the User must verify the final sale price before submitting the order form.

 

PAYMENT METHODS

The payment methods accepted by Tenuta Mosole are Credit Card. All financial information required for the transaction will be transmitted, via encrypted protocol, to the banks providing the relevant remote electronic payment services, without any third-party access. This information will never be used by Tenuta Mosole except to complete the purchase procedures and to issue refunds in the event of product returns, following the customer’s exercise of the right of withdrawal, or if it becomes necessary to prevent or report fraud to law enforcement authorities related to mosole.com.

 

SHIPPING

Tenuta Mosole delivers the ordered products via national and international couriers, who take full responsibility for the delivery from the time the products are picked up at our facility until they are delivered to the address specified in the purchase procedure.
The list of available countries may change, so it is recommended to verify delivery availability before proceeding with the completion of the purchase order.

 

**RIGHT OF WITHDRAWAL**

Purchases on mosole.com are subject to the regulations of Legislative Decree 206 of 2005, which guarantees the right of withdrawal.

Returned products must be intact, preferably in their original packaging; damaged or altered products will not be eligible for the right of withdrawal.

The right of withdrawal is reserved solely for individuals previously defined as “consumers,” excluding any purchases made by resellers or by entities purchasing for resale purposes.

To exercise this right, the User must follow this procedure:

1. Send an email within 14 days from the date of receipt of the goods, indicating:
– Invoice number
– Order number
– Order date
– The product(s) for which the right of withdrawal is being exercised
– Bank details (IBAN code) for the refund

2. Wait for the return authorization email from Tenuta Mosole.

3. Within 15 days of receiving the return authorization email, ship the products for which the right of withdrawal is being exercised to the following address:
Tenuta Mosole – Via Annone Veneto 60 – Località Corbolone – 30029 S. Stino di Livenza – Venice.

The refund for the products subject to the right of withdrawal will be made within 14 working days from the receipt of the goods. This refund does not include shipping costs, which are borne by the Customer, in accordance with Article 5 of Legislative Decree No. 185 of 22/05/1999.

In general, for matters not explicitly stated, the legal provisions regarding distance contracts apply. Any disputes will be subject to Italian jurisdiction.
